  • MySpace lawsuit dismissal upheld

Court sides with MySpace in suit over sex assault:

The 5th U.S. Circuit Court of Appeals upheld the decision to dismiss the infamous $30M lawsuit against MySpace.

The family of 24-year-old Julie Doe filed a lawsuit against MySpace after she was sexually assaulted by 19-year-old Pete Solis who met her over MySpace.

  • Solis gets 90 days

Man gets 90 days in jail assaulting teen met on Myspace:

Pete Solis has pleaded out to a 90-day sentence for sexually assaulting a teenage girl he met on MySpace. Solis was looking at federal charges if he did not agree to the plea. Solis will be a registered sex offender.

If his name sounds familiar it’s because his victim was ‘Julie Doe’ whose mother failed at suing MySpace for $30M.

  • $30M MySpace lawsuit not dead yet

Family seeks revival of MySpace suit over alleged sex assault:

The Texas family that had tried to sue MySpace over their daughter’s sexual assault are trying to get the suit revived.

The victim, only known as Julie Doe was 14 when she was sexually assaulted by then 19-year-old Pete Solis. Solis had met his victim over MySpace. He’s now in prison for the sexual assault.

However, the family of Julie Doe sued MySpace for 30 million dollars. The lawsuit was summarily dismissed. Now the family is asking the 5th U.S. Circuit Court of Appeals in New Orleans to overturn the dismissal.

As much as I sympathize with the family for what their daughter went through I just have to reiterate that MySpace is not at fault and this comes off as just a grab for money.

    Pete Solis gets trial date

Trial date set in MySpace sex assault case:

You all remember Pete Solis, don’t you? He was the catalyst behind the infamous $30M lawsuit against MySpace. Solis was the one who allegedly sexually assaulted a 14-year-old girl who he met over MySpace. Which led the victim’s mother to file one of the most frivolous lawsuits of all time. Anyway, Solis’ trial date for the sexual assault is set to start on January 28th.

    Which Amendment is that exactly?

Attorney for “My-Space” Attacker Claims Constitutional Protection:

For those of you who may have forgotten, Pete Solis is the 19-year-old at the crux of the MySpace lawsuit. The victim’s mother is suing MySpace because Solis sexually assaulted her 14-year-old daughter. Solis’ attorney in the criminal proceedings has made possibly the most outrageous legal claim ever this side of bad police and lawyering shows on TV…

The attorney for a 19-year-old man accused of sexual assault claims the U-S Constitution protects him from full responsibility for having sex with a 14-year-old girl.

Yes, you read that right. I’ll let you continue now…

Pete Solis reportedly met his victim via “My-Space.com,” apparently leading to dinner and a movie back in May, allegedly followed by sexually assaulting the victim afterwards in a shopping center parking lot.

“We are saying that to create liability for only one party–for the older party, and not the younger party–that violates Equal Protection,” attorney Adam Reposa says outside a Travis County courtroom this morning.

Reposa claims that extends to protection of procreation rights, despite the victim’s age. He maintains that he is not trying to vilify the 14-year-old victim.

Solis would face up to 20 years in jail and permanent registration as a sex offender, if he’s convicted. A judge will hear Reposa’s argument next Monday.

Yeah, I had to pick my jaw up off the floor too.

Is this assclown serious? Constitutionally protected child molestation? If any judge allows this, they should be immediately removed from the bench, dragged out into the street, and pelted with rocks and garbage. And so should this attorney for even attempting such a defense.

Buda Man Indicted In MySpace Sexual Assault:

(CBS 42) A Buda man accused of sexually assaulting a girl he met on MySpace.com has been indicted.

Pete Ignacio Solis, 20, is charged with the assault of a 14-year-old girl in May.

According to police, Solis picked up the girl at Bowie High School and assaulted her in the parking lot of an apartment complex at Westgate and William Cannon.

If the name Pete Solis sounds familiar, it’s because he’s the alleged perpetrator in the middle of the MySpace lawsuit.

A Fourteen-Year-Old Girl’s Suit Against MySpace: Should Networking Sites Be Legally Responsible for Protecting Teens from Harmful Real-World Conduct?:

This is a great and lengthy article about the viability of the MySpace lawsuit. It’s a great read but the last paragraph, in my opinion, sums up the whole situation…

At the end of the day, however, as long as users are willing to lie and circumvent, there is a limit to how effective controls can be. There are inherent perils involved in hooking up in cyberspace – and parents need to be the ones who educate their children about such dangers.

    Hopefully, common sense will prevail.

  • Another Lawsuit?

    Another Lawsuit?

TIME.com: A Countersuit in the MySpace Case?

A 14-year-old girl is suing the social networking site, where she met the man charged with sexually assaulting her. Now the man she says assaulted her may pursue his own legal case against MySpace.

It has been an unlikely legal wrangle from the start. First, a 14-year-old Austin, Texas, girl and her mother filed a $30 million lawsuit against MySpace.com, where the teenager claims she met a man who assaulted her. Now, the college student charged with the sexual assault also is considering suing the popular social networking site.

The defense attorney for Pete Solis, the 19-year-old Texas community college student charged with sexually assaulting the girl dubbed “Julie Doe” in her lawsuit, told TIME that if the Texas courts accept the premise that MySpace is liable because the two met there, then his client also has a claim, since the alleged victim falsely portrayed herself on the webiste as 15 years old.

“He’s been, in effect, just as much a victim — if not more,” says Adam Reposa, the attorney for Solis, who is facing up to 20 years in prison on charges of second degree felony sexual assault. Since the lawsuit against MySpace also names Solis as a defendant, Reposa said he will “cross-file” and also sue MySpace and its owner, News Corporation. “MySpace wasn’t there when they went to Whataburger. MySpace wasn’t there when they went to the movie and MySpace wasn’t there when they climbed in the backseat,” Reposa said. “Meeting on MySpace — if that alone is enough, then we can make the same claim for damages.”

    This has officially gotten ridiculous.
