    “He never had intent to kill her,” Schorling’s attorney, Arthur Garton, told the jury. “We’re conceding great bodily harm. He did everything he could to avoid this. (But) he acted impulsively. He thinks like a kid. He acts like a kid. And he reacted like a kid.”

    So let me get this straight. By plunging a kitchen knife into almost the dead center of her back meant he wasn’t trying to kill her? In what universe? Is this the best Mr. Garton could come up with? I hope they’re not paying him much. Let’s not forget that he escaped from juvenile detention in order to allegedly finish what he started. But I guess that was just to not kill her some more.

    I have some questions in regard to Scott Dyleski…

    1. For those of you who say I’m condemning Scott Dyleski because he’s “different” then why are you defending him just because he’s “different”?
    2. More than one angst-ridden teen killer that I’ve discussed (Esmie Tseng, Jeff Weise, etc.) have had LiveJournals. I know that there was a fake MySpace attributed to Scott Dyleski, but I wonder if he had a LiveJournal. If anyone knows whether he did, please let me know. I wouldn’t mind the URL to the fake MySpace either.

    High school stabbing suspect to fight charge:

    In an act of either defiance or stupidity, Eric Schorling, against the advice of his attorney, has opted to go to trial instead of pleading guilty to attempted murder in the stabbing of Nicole Lambert.

    Why is that a big deal? To refresh your memory, Eric Schorling bragged to people that he was going to stab his ex-girlfriend, Nicole Lambert. He then stabbed Nicole in the back in the halls of Romeo High School, barely missing her heart. He then bragged to people afterward that he stabbed Nicole. He had made a plea to serve six months, but then nullified that plea by escaping from Macomb County Juvenile Justice Center and telling people that he was going to finish the job he started.

    So instead of serving eight years on a guilty plea, he’s taking it to trial, where he could end up serving life in prison. The thing is, both families had agreed to the eight-year plea.

    According to the article, assistant prosecutor Steven Kaplan said that he’s going to try to garner sympathy from a jury. What possible sympathy could he get? He said he was going to stab Nicole. Stabbed her in front of at least one witness, bragged about it, then tried to escape detention to finish the job.

    With any luck, the only sympathy he’ll find is in the dictionary, and you know where that is, don’t you? Between shit and syphilis.

    The other day I briefly touched on Scott Dyleski’s upbringing and family life.

    I had speculated that it sounded like he lived on some kind of commune with few rules or boundaries. I also mentioned that local media were saying that Scott Dyleski’s mom was “a long-distance healer who believes that DNA strands can be activated to alleviate disease”.

    If you wondered what that means, wonder no more. Steve Huff was kind enough to send me the link to Scott Dyleski’s mom’s commercial website. It may give somewhat of an insight into the family life of Scott Dyleski. Let me give you some choice quotes from the website…

    Fears, blocks, programs, negative self-images can act as bars on a cage to keep us from fulfilling our full potential and living our dreams. Fears and blocks can numb our brain so that we can’t even see the bars. Negative programs can make us believe that we only deserve pain and illness, we aren’t worthy of health, joy, or love.

    It doesn’t say how DNA activation is achieved, but I wonder how they view the treatment of depression. I wonder if “long-distance healing” was used locally instead of legitimate professional help.

    Possible sanctions regarding McGill’s football forfeits put on hold:

    Earlier this week, I commended McGill University for canceling the remainder of its football season in the wake of the “Dr.Broom” hazing scandal. It turns out there were only two games left in their regular season.

    Not only that, but it’s also wreaking havoc on the schedules of other universities in their league.

    I realize that hindsight is 20/20 but looking back what they should have done was kicked the offenders off the team and let the rest of the players play out the remainder of the season.

    Looking back, that would have been even more punishment for the offenders to watch their teammates play as they sit the rest of the season out. But at least McGill took some actions instead of none at all.

    16-Year-Old Charged As Adult In Vitale Murder Case:

    A 16-year-old boy facing charges as an adult in the alleged murder of Pamela Vitale, the wife of prominent defense attorney Daniel Horowitz, was held in lieu of $1 million bail Friday.

    Scott Dyleski appeared briefly in a Contra Costa County courthouse for the first time since his arrest for allegedly beating Vitale to death in the hilltop estate where the couple were building their dream home in the wealthy suburb of Lafayette, about 20 miles east of San Francisco.

    If Dyleski is convicted of murder, he would face up to life in prison. He’s too young to face a possible death penalty.

    Usually, in cases of violent crimes involving teenagers, I usually ask where were the parents. In the case of Scott Dyleski killing Pamela Vitale, we now know the answer…

    The crowded home, shared by three families and recently, invaded by mice, is just down the one-lane rural road from the modular home where Vitale lived with her star-attorney husband, Daniel Horowitz, next to the palatial house they have been building.

    Dyleski and his mother moved from Sebastopol to the Lafayette hills about six years ago and set up a lean-to on her friends’ property.

    Dyleski slept on a thin mattress on pallets through his middle school years, until the landowners, Kim and Fred Curiel, built a house using ecological materials in 2002 and they all moved inside, Marcus said.

    A family friend said the family is very tolerant and gave Dyleski space.

    “They wanted to give him that freedom,” he said.

    The words “hippy commune” leap immediately to mind.

    16-year-olds shouldn’t have unlimited “freedom” as they say. It doesn’t matter how smart the kid may be. 16-year-olds need boundaries and guidance. It seems like to me that Dyleski was allowed to roam free without any fear of parental reprisal. Sounds like another case of the parent wanting to be a friend rather than a parent.

    Yesterday I wondered how Dyleski went from a relatively normal kid to the dark and foreboding figure he has become…

    Friends said Dyleski started to change about the time his father’s daughter, Denika Dyleski, and a 19-year-old boy were killed in a car crash while driving on Ygnacio Valley Road. A 17-year-old friend was driving too fast and flipped the car on a curve, hitting two other vehicles.

    After that Dyleski started wearing dark clothing, entered a gothic, Marilyn Manson phase and stopped talking openly, Marcus said.

    Why is it when anything “goth” makes the headlines, the media automatically points to Marilyn Manson? While I’m no fan of Manson, he’s not goth his music is considered industrial, but I digress.

    It’s obvious he was suffering from depression. Was any professional help sought out or did the commune try some new age approach considering Dyleski’s mom is “a long-distance healer who believes that DNA strands can be activated to alleviate disease”, whatever that means.

    And as usual, a recurring theme rears its ugly head…

    Everyone seems to agree that Scott stood out, and got picked on for being different.

    And why, you might ask?

    Some students said Thursday they had long considered him “weird” or “creepy,” and not only for the black trench coat he wore nearly every day.

    One remembers him coming to school one day in full face paint, dressed up as a sort of gothic clown with a top hat. The student also mentioned his dark personality, evidenced by charcoal drawings of “people with their mouths sewn shut and eyes with nails through them dripping blood.”

    I’m all for the idea of individual expression, but when you stick out so much you’re bound to invite trouble from the more ignorant parts of society.

    What’s my point? My point is this. All the things I’ve mentioned above will be used as a defense when Scott Dyleski comes to trial. All these things will be used as an excuse. I’ll even go as far as to predict that there will be people who support him just because he’s different. None of that excuses what he did.

    Ultimately, Scott Dyleski is responsible for his own actions and hopefully, a California jury will realize that.

    16-year-old male arrested in brutal Vitale slaying:

    I wasn’t going to do anything about the brutal murder of Pamela Vitale, wife of well-known defense attorney Daniel Horowitz.

    It’s such a high-profile case, I felt that it was going to be over-blogged. That was until they arrested a suspect, one 16-year-old Scott Dyleski. Here’s what piqued my interest in this…

    Authorities believe Dyleski killed Vitale, 52, on Saturday by striking her 39 times in the head with a piece of crown molding, then carved some kind of gothic signature into her back, the source said.

    Now, read that with a grain of salt. We all know how people unfamiliar with the goth scene mistakenly assume something is goth when it isn’t. But after seeing the kid, I wouldn’t be surprised if it was.

    One student who knows Dyleski said the teenager was a typical kid until the eighth grade, when his personality and demeanor darkened noticeably.

    I’m curious as to know why.

    The motive for the killing appears to stem from a credit-card theft scheme allegedly carried out by Dyleski and another teenage friend, who has not been implicated in the killing, one source said on condition of anonymity.

    Investigators believe Dyleski and his friend planned to start a marijuana-growing operation, with Dyleski in charge of raising money, one source said. Dyleski is believed to have stolen credit card bills from several mailboxes and used the cards to order supplies, the source said.

    According to the article, sources are saying Dyleski will be tried as an adult. Instead of doing maybe two years in juvenile detention for fraud, he could be looking at least life behind bars.

    Marvin Osantowski, the father of would be school shooter Andrew Osantowski, was sentenced to 18 months probation after pleading guilty to receiving a stolen golf cart from his son…

    In exchange, prosecutors dropped charges that Marvin Osantowski helped his son hide a cache of weapons, including an AK-47, bomb-making devices and hundreds of rounds of ammunition in the family home in Clinton Township.

    Marvin Osantowski, a DaimlerChrysler employee with disabilities, said he accepted the plea deal to spare his family a trial on the weapons charges.

    “To keep Andrew out of the news, I chose this route,” Osantowski said. “Am I happy it took so long? No.”

    Biernat also modified Marvin Osantowksi’s probation terms to allow him to visit his son in the Macomb Correctional Facility in Lenox Township.

    Just another article about McGill University canceling the remainder of their football season but check out some of these quotes from the players and coaches…

    Mr. McMann, the head coach, acknowledged yesterday that his players’ hazing went too far, but he was disappointed with the university’s punishment.

    “I feel very upset for the players,” he said when reached at his office. “I understand where the university is coming from. They need to make a strong statement. But I don’t like it. I think the players have been punished enough.”

    Punished enough? Have the players had their asses probed with broomsticks? Well, actually they have…

    Team quarterback Matt Connell also expressed anger over the findings, saying the hazing ritual dates back years, and all the rookies except the complainant went along with it.

    “It happened to me. It’s a quick part of initiation,” he said, scoffing at the revelations of nudity.

    “It’s football. You’re naked together 24-7 in the locker room,” Mr. Connell said. “Everyone’s naked together all day.”

    Um….yeah. I don’t think I’ve ever read anything that sounded gayer. Not that there’s anything wrong with that. This guy sounds like he’s so far in the closet he’s finding Christmas presents.

    Anyway, the “It happened to me” defense is so wrong. That’s like saying “Well I was raped so it’s ok for me to be a rapist”.

    And all over a game that children play.
