  • Werribee victim may have had relationship with suspect

    Werribee DVD tryst twist:

    THE girl at the centre of the Werribee DVD sex assault investigation was allegedly in a continuing relationship with one of the teens.

    Copies of the DVD, which showed sexual acts and the girl’s hair being set alight, were sold at schools.

    Sources have told the Herald Sun at least one of the teens caught on the DVD continued a relationship with the victim for several months after the degrading film was made.

    Police are investigating whether rape charges can be laid against any of the teens involved.

    The relationship may become vital in investigations as to whether consent for sex was given during the filming of the DVD, titled C— the Movie, and the charges police can lay.

    And so what if she was? Does that make the assault any less wrong?

    However, I do like this part…

    It is possible some of the youths captured in the crude DVD may be charged as adults.

    At least one of the youths questioned by police has turned 18 since the offences took place in June.

    Most of those in the video are believed to be aged 16 and 17.

    Under Victorian law a person can be tried as an adult if they have turned 18 since the offence.

    I wish they would try this in the U.S.

    Campbell County High School shooting case goes back to juvenile court:

    The attorney for Kenneth Bartley, the teenage gunman from Campbell County High in Tennessee who killed assistant principal Ken Bruce and wounded principal Gary Seale and assistant principal Jim Pierce, wants to have the trial moved back to juvenile court…

    In March Bartley agreed to be tried in adult court, but now he wants a hearing on the matter. So the case will at least temporarily go back to juvenile court. Thursday the judge set April tenth as a tentative trial date if the case comes back to adult court.

    “If they want to have a hearing in juvenile court, we don’t want to deny them any right, but we’re confident that we’ll have the trial in April here in criminal court,” said District Attorney General Paul Phillips.

    Hopefully, it will stay in adult court where it belongs. Murder is not a juvenile crime.

    MySpace sex case prompts Internet parental warning:

    SHELBY TOWNSHIP — Macomb County’s top cop warned parents Tuesday about the potential dangers their children face on the Internet after a 22-year-old man was charged with having sex with an underage girl he met on the popular MySpace.com Web site.

    His comments come a day after Peter Kennedy, 22, of West Bloomfield was charged with having sex with a 14-year-old girl in Shelby Township.

    Police are not disclosing the girl’s identity because of her age.

    “He apparently had contacted the girl days before through MySpace.com,” said Sgt. Stan Muscynski of the Shelby Township Police Department’s Detective Bureau.

    Kennedy was arraigned Monday before Magistrate Michael Osaer in the 41-A District Court in Shelby Township on a first-degree criminal sexual conduct charge. Kennedy faces up to life in prison for the charge.

    Osaer set bond at $250,000 bond. Kennedy remained in police custody Tuesday at the Macomb County Jail.

    Kennedy’s attorney, Bloomfield Hills-based Elias Muawad, said the girl voluntarily left her home and met with his client and is now claiming forced sexual conduct.

    “Force is the key thing here,” he said. “My client also believed the girl was 16 because of statements she made to him.”

    The girl may have also told Kennedy she was 16 in exchanges they had over the Internet, Muawad said.

    “I’m hoping she doesn’t ruin this young man’s life and tells the truth about (giving her consent),” he said.

    A preliminary exam for Kennedy is scheduled for Nov. 20 before District Judge Douglas Shepherd.

    Kennedy was arrested after a police officer on patrol found him engaged in sex with the girl in a car at about 3 a.m. Sunday, said Muscynski.

    The car was in a parking lot in the 24 Mile and Van Dyke area, he said.

    The old “she said she was 16” defense. You know, just because it may be legal for a 22-year-old to have sex with a 16-year-old doesn’t make it right.

    Anyway, I was unable to find a current MySpace for this loser.

    Police say Bethel man met teen on MySpace:

    Yet even another MySpace creeper from Connecticut. Is it something in the water?

    BETHEL — The 46-year-old Bethel man charged with attempted sexual assault after police found him in a parked car with a 15-year-old girl last week met the teen on MySpace.com, police said.

    Bethel Police Chief Jeffrey Finch said Monday that Harry Denney, of Rockwell Drive, met the underage girl on the popular social networking Web site about a year ago.

    He wouldn’t say if Denney and the teen had contact prior to the meeting that resulted in Denney’s arrest in the high school parking lot Friday.

    Officers who were patrolling the lot during a football game between Bethel and New Milford found the pair in a “suspicious vehicle” parked in a rear corner of the lot. Finch wouldn’t say what attracted attention to the car.

    In addition to the sexual assault count, Denney was charged with risk of injury to a minor and loitering on school grounds. He was released on $10,000 bond for an appearance Nov. 14 in Danbury Superior Court.

    The age difference between them is almost my age.

    I was unable to find Denney’s MySpace. Hopefully, a tipster will provide.

    Will wonders never cease? Robin Kittrell, the Georgia teen who brought guns to school allegedly to prevent a Columbine-like attack, has actually pleaded guilty to six counts of possession of a weapon on school property, one count of carrying a concealed weapon and two counts of underage possession of a firearm. Not only that, but no deal was struck along with the plea.

    This is the kind of the kid who deserves help. Not the kid who shoots up his school or kills his family. It’s obvious to me that this kid had good intentions but incredibly bad judgment. It’s not too late for him.

    17-year-old sex assault suspect goes before judge:

    A registered sex offender who had been attending classes at Pasadena High School went before a judge Friday.

    He was there to hear the newest charge against him.

    Valentine Lopez, 17, is accused of sexually abusing a 14-year-old girl he met on Myspace.com.

    The school district said it was already aware of his conviction three years ago for a sex crime against another child.

    But, officials added, there was nothing it could do at the time to separate Lopez from the other students.

    Lopez was taken into custody Wednesday, according to police.

    According to the DPS Website, Lopez is a registered sex offender, convicted in 2003 for a sexual assault case that involved a three-year-old victim.

    Pasadena ISD Superintendent Kirk Lewis explained that though the district was aware of Lopez’ past record, there was nothing they could do aside from providing the teen with an education.

    “The district will do everything it can always to protect its’ students,” he said. “In this particular instance, there were legal restrictions that prevented us from doing anything more than what we had already done. My understanding is that they’re currently working through the process for suspension, and completing the paperwork to have him moved to an alternative placement (facility).”

    According to Lewis, any student that lives within any school district must be provided an education by that school district. People were not notified of Lopez’ past convictions, said the superintendent, because the teen was protected by juvenile and privacy laws.

    It’s nice to know that a sex offender’s right to privacy outweighs the safety of the other kids attending that school.

    Hainstock’s Lawyer Fights School Records Seizure:

    Eric Hainstock’s attorney, Debra O’Rourke, is trying to get school records subpoenaed by the prosecution excluded. She claims that the records are confidential, and the subpoena does not show how they are relevant to the murder of Weston Schools principal John Klang.

    District Attorney Pat Barrett is arguing that the records are relevant, stating that Hainstock had issues with numerous students over the past three years and that he was going to “see” them the day he killed Klang.

    O’Rourke also said that the school did not fulfill her request for the records, even though she had permission from the family.

    Judge Patrick Taggart will rule on the matter in two weeks.

    JOLIET, Ill. — A man who used the popular, youth-oriented MySpace.com Web site to arrange a sexual tryst with an underage Naperville girl has been sentenced to two years and two months in prison for that crime.

    Will County Circuit Court Judge Daniel Rozak meted out the prison term to Jay D. Coffield, 44, of Morris, state’s attorney James Glasgow confirmed Monday in a written statement.

    Coffield pleaded guilty Friday to a felony charge of indecent solicitation of a child. The allegation stemmed from his efforts earlier this year to arrange a sexual rendezvous with a 14-year-old Naperville girl.

    The girl’s 21-year-old cousin contacted Naperville police Detective Rich Wistocki on May 22, after discovering “inappropriate comments” directed at the teenager on the girl’s MySpace page, Glasgow said.

    “Taking a page from the online watchdog group Perverted Justice, this amateur sleuth set up her own undercover account online and began talking to Coffield online,” Glasgow said of the girl’s cousin.

    She then turned her account and other information over to Wistocki, the Naperville Police Department’s Internet Crimes Unit investigator, Glasgow said.

    Wistocki, posing as the teenager, continued corresponding with Coffield, who used the MySpace screen name of Mistercee42.

    Coffield ultimately suggested the girl meet him the evening of June 9 in a coffee shop near 95th Street and Route 59 on Naperville’s far southwest side. He indicated he would then take her to DuPage River Park, near Royce Road and Naper Boulevard on the city’s far southeast side, where they would have sex, police said in June.

    Coffield arrived at the coffee shop around 6:15 p.m. and was arrested immediately. Coffield, who had no criminal record at the time, told police it was the first time he had tried to arrange a meeting with a girl he had chatted with over the Internet.

    “No longer an anonymous Internet surfer looking for vulnerable children, Jay Coffield now will have a public prison sentence and his face online among other Illinois registered sex offenders,” Glasgow said.

    “Instead of just picking up the pieces after a child has been violated, we were able to expose and punish a predator before a child’s life was tragically affected.”

    Paula Teeter, a worker with the Ministry of Child and Youth Services, testified Thursday in a Peterborough court that the man is the oldest “young offender” in the province and is still at a high risk to reoffend.

    The man had finished serving his original sentence of three years in November 2003, but a judge had ruled he was still dangerous and should be held indefinitely.
