The victim’s mother is suing MySpace because Solis sexually assaulted her 14-year-old daughter. Solis’ attorney in the criminal proceedings has made possibly the most outrageous legal claim ever this side of bad police and lawyering shows on TV…

The attorney for a 19-year-old man accused of sexual assault claims the U-S Constitution protects him from full responsibility for having sex with a 14-year-old girl.

Yes, you read that right. I’ll let you continue now…

Pete Solis reportedly met his victim via “My-Space.com,” apparently leading to dinner and a movie back in May, allegedly followed by sexually assaulting the victim afterwards in a shopping center parking lot.

“We are saying that to create liability for only one party–for the older party, and not the younger party–that violates Equal Protection,” attorney Adam Reposa says outside a Travis County courtroom this morning.

Reposa claims that extends to protection of procreation rights, despite the victim’s age. He maintains that he is not trying to vilify the 14-year-old victim.

Solis would face up to 20 years in jail and permanent registration as a sex offender, if he’s convicted. A judge will hear Reposa’s argument next Monday.

Yeah, I had to pick my jaw up off the floor too.

Is this assclown serious? Constitutionally protected child molestation? If any judge allows this they should be immediately removed from the bench, dragged out into the street, and pelted with rocks and garbage. And so should this attorney for even attempting such a defense.

    Has this alleged attorney ever had a 14 year old child? Has he even been close to a 14 year old child? Would he be willing to give up his child to just any adult who comes along and flatters the child?

    The question that needs to be considered is this: Is it actually impossible for a 14 year old child to decide what to do with her body? Laws should be ammended to not specify an age when a person can consent to sex, rather be defined biologically that all post-pubescents are capable of making decisions of whether or not they want to have sex and, if so, with whom they will commit the act. I’m pretty sure nature has a better idea of when someone is ready for sex than a government does. The US has been in existence for a mere 230 years, human beings have been having sex for tens of thousands.

    I dont know about that, the biological aspect isnt entirely reliable… we are not a wild species… besides in that view a child would still usually have a family group to decide (observe/control) procreation… still not the best as history shows, I think its just like our sense of hunger… never have there been so much/many signs and signals (advertising/etc) of food… SO we eat too much, Its the same with all the sexual imagery of life in general… the lines have blurred because of the constant stream of product and commerce potential… its changed/ing the culture… My personal belief is although popular culture has made children attractive… ((seen those juicy pants on kids?wth?)) popular culture has also made murder and death…Cool. That DOES NOT mean its OK to kill people.

    It’s sick to molest anyone of course, and lawyers tend to be pretty full of shit most of the time. Rape will effect these girls for the rest of their lives….that said, a 19 year old “man” is not doing wrong having sex with a 14 year old girl illegal or not. I don’t know how many of you remember being in high school, but male high school seniors date female high school freshman very very often. I understand no one would be on my side in saying this, because it simply sounds disgusting. Does it sound disgusting because it is disgusting? No. It sounds disgusting because of the law, and because of the way society has progressed. Should a high school senior dating a high school freshman be considered a sexual predator? In my opinion of course not but i’ll let the rest of you have your opinions. Don’t at all try to demonize me for condoning rape, or physical abuse of a minor, because unless you are mentally challenged it should be obvious that’s not my point.

    I agree. This goes back to my last post about how having a law based simply on a given age is completely arbitrary and ridiculous

    Let’s consider the following example. A 20 year old asks a girl on a date the night before her 16th birthday. They decide to go to a movie at 10 pm and the movie is two hours long. According to the law in most states, if they were to have sex before going to the movie, he is committing a crime. Yet, she somehow during the course of the movie, magically gains the enlightment that allows her to consent to sex. So if they then have sex after the movie, everything is fine. Tha must have been one hell of a movie.

    The simple fact is, teenagers mature at different times. There are certainly 14 year olds who are capable of consenting to sex, and there are certainly 16 and 17 year olds who probably aren’t mature and emotionally stable enough to do so. Therefore these laws should be changed to allow a more case by case basis to be applied.

    Actually, I’ve been making these arguments since I was about 15 years old. You can’t really question the logic. See the case in my previous post… are you seriously trying to tell me those two hours can make a difference? Yet in the view of the law they do. Furthermore, a look at the vast majority of state consent laws place the same age of consent for boys and girls. Yet it has been scientifically proven girls mature earlier than boys. If this is true, how can they consent to sex at the same age?

    Well, as I’ve said before, it’s a case by case thing. Is it frowned upon? Usually. But that’s not the question here. The question is should it be illegal? Is this girl incapable of deciding that having sex with a 24 year old is what she wants? And I don’t think that is the case everytime.

    Why is it illegal? For the same reasons it’s illegal for 14-year-olds to drive, smoke, drink, vote, and enlist in the armed forces. Should all those things be made legal as well?

But what exactly are those reasons? You have yet to make an argument based on any logic. Come back to me when you learn how to debate.

    Because as much as you’d like to believe it most teenagers aren’t mature enough to make rational decisions regarding such matters. Go to just about any teenager’s MySpace and you’ll get a sense of just how immature they really are.

    That’s fine and all, but sex and driving, drinking, smoking, voting, or joining the military are different matters. There is no biological directive telling you to vote or drive, none telling you to drink or smoke unless you’ve done so already, none telling you to fight for the survival of your country. There is, however, a biological directive telling you to procreate. And this direcive is activated at puberty. From that time on, from a biological perspective, your main objective is to pass on your genes for the good of the species. As stated in my first post, nature knows better when the right time for this is than we do. Granted nature is not aware that kids don’t hold jobs, go to school, or have ways of providing for their young, but it’s the driving force that allows any post pubescent to make this decision. Any laws statig otherwise are a violoaton of nature.

    Furthermore, you have yet to contradict my previous point. What is the maturity difference between a 16 year aold and someone 15 years and 364 days old? I’ve been arguing the whole time that these laws need be on a case by case basis. I never stated that it is never wrong. you just keep hammering away the same old point not relevant to my own comment.

    …. Still waiting on those debating skills.

    You have to draw the line somewhere. If you don’t then the pedophiles will have a field day arguing that if this case is allowable then having sex with an 8-year-old is ok too. But hey, if you want even more teen pregnancies and a larger number of teens infected with STD’s then by all means have at it.
